broad,asisexemplifiedaboveallbyindividualrightsandfree-
domsandbytheconstitutionalizationofnumerousorgans
thatarenotexplicitlyincludedinthetripartiteadministration,
e.g.,RzecznikPrawDziecka(OmbudsmanforChildren),Krajowa
RadaRadiofoniiiTelewizji(NationalBroadcastingCouncil),or
RadaPolitykiPieniężnej(MonetaryPolicyCouncil).Thisdoesnot
meanhowever,thatthisregulationisfullyprecise,sincedifier-
encesinitsinterpretationdooccur,includingdisputesregard-
ingcompetencies,thebestexampleofwhichwasthedispute
betweenthepresidentoftheRepublicofPolandandtheCoun-
cilofMinistersoverstaterepresentationatmeetingsofEuro-
peanUnionorgans.
5.Thesecondoftheelementscomprisingtheprincipleofthe
ruleoflawislegalism.Thisreferstoboththespheresofcreating
andenforcinglaws.Thecontentoflegalismstemsprimarilyfrom
article7oftheConstitution,whichstatesthatHpublicauthori-
tiesshalloperateonthebasisandwithinthelimitsofthelaw.”
ApartfromtheConstitutionalTribunal,theseauthoritiesarenot
inapositiontojudgethecompatibilityoflegalnormswiththe
normsofhighergovernmentsincethefundamentalprinciple,
asimpliedbytheprimacyoftheConstitution,isthepresump-
tionoftheconstitutionalityoflegalnormsthathavebeenissued
lawfully.Thisdoesnotmean,however,thatthereisnopossibil-
ityofsettingasidethesenormsthroughproceedingsbeforethe
constitutionalcourtorbeforeadministrativecourtsinthecaseof
locallaws.Implementingtheprinciplesoflegalismsinlawmak-
ingprimarilyregardsformalcorrectnessassociatedwiththepro-
ceduresforenactinganormativeact,andalsothecorrectnessof
competence,whichreferstothenecessityofadoptingagiven
actbytheorganwhichhastheauthoritytoissueit.Inthecaseof
executiveactsandinternalacts,anotherrequirementissubstan-
tivecorrectness,whichislinkedwiththenecessityofreferringto
thestatutorylegalbasisfortheirissuance.However,legalismin
lawenforcementisconcentratedonthenecessityofissuinglaw
enforcementactsbasedonaconcretelegalfoundation,where-
bythisfoundationinthecaseofdecisionsaddressedtoexternal
