Tecloseconnectionbetweenadministrativeproceduresandadministrative
actswasfullyjustifiedattheiroutset.Aferall,theadministrativeactwastobethe
legalactparexcellenceoftheAdministration.Inourdays,eventhoughtheadmin-
istrativeactcontinuestobearundoubtedrelevance,itcannolongerbeconsidered
theexclusiveobjectofadministrativeprocedure,giventhemanytransformations
undergonebycontemporaryadministrations,themanydińerentlegalactsthey
apply,thevariedresponsibilitiesassumedbypublicauthorities,andtheplurality
ofunderlyingmodelsofgovernmentandadministration(2).Succinctly,today’s
administrativeprocedureisacentrallegalinstitutionwhosescopefarexceedsits
originalfunctionofmerelychannelingtheissuanceofadministrativeacts.
Nevertheless,itisstillcommontodaytofindtreatisesonadministrativelaw
thatcontemplateaunitaryandamalgamatedvisionofadministrativeactsand
administrativeprocedures,eveninlegalsystemswhereinthegeneralstatutesonad-
ministrativeprocedure,(uadministrativeprocedureact”
,hereinaferAPA)contain
additionalproceduresforthedrafingofotherlegalacts,suchasrulesandregula-
tions,publicagreements,andadministrativecontracts.Beyondthemorecompre-
hensibleexplanations(suchashistoricaltradition,orthefactthat,asintheIbero-
Americanmodel,thesubstantiveregimeofadministrativeactisestablishedin
theAPAitself),itseemsthatthisreductiveviewisduetotheabsenceofamoreho-
listicandupdatedcontemporarytheoryofadministrativeprocedure,thedevelop-
mentofwhichneedscontinuedrefinement.
Tothisend,itisdesirabletorethink,first,theconceptofadministrativeproce-
dureandtherolethatthegenerallawsofadministrativeprocedureshouldperform
(3-4).And,secondly,distinguishthedińerentcoexistentspeciesorgenerationsof
administrativeprocedure(5).Tiswillallowsomeconclusionstobemadecon-
cerningthedińerentlegalregimesthateachofthesespeciesmayrequire,which
expanduponthecommoncore(6).
Inotherwords,thisarticlewillattempttosystematiseacomprehensiveaccount
ofadministrativeprocedurebydistinguishingthemainlegaltrendsfromboth
ahistoricalandacomparativeviewpoint,andbyoutliningaconceptualframe-
work,whichwillservetodevelopacontemporarytheoryofadministrativepro-
cedure.Becauseofspacelimitations,wecanonlypointoutthemostgeneralre-
marks,andrefertoother,previousworksformorein-depthexplanations.
