Inaccordancewiththemethodologyrecognizedbyitsauthors,astarting
pointforthejustificationofanylegislativeactionwasthereconstruction
ofaspecificcase,originatingfromacontextofmedicine,andscientific
research.mesecondstageofthismethodwasthephilosophicalanaly-
sisoftheissuesinquestionandadepictionoftherelatedfundamental
moraldilemmas.Byreturningtothephilosophical,thepossibilityof
fathomingtheessenceoftheproblemhadbeenenabled.
mecontroversywhichsurroundsthequestionofhumanbiogenesis
requiringappropriatelegislativesolutions,alongwiththeongoingpro-
gressbeingmadeinthenaturalsciences,iseverontheincrease.Abortion,
assistedprocreation,prenatalandpreimplantationdiagnosis,cloning,new
variationsofeugenics,surrogatemotherhood,researchemployinghuman
embryosandtheharvestingoftheirstem-cellsmakeupjustafewofthe
controversiescurrentlythesubjectofcontesteddebate.Everyoneofthese
debatesandtheensuingdiscussionbringswithititsownindividualhis-
toryanddetail.Uponmovingon,however,fromthedetailsofsuchspe-
cificities,whichhaveallrevolvedaroundessentiallythesameissue,one
questionremainssingularlyunanswered:KWhatstatusdoesthehuman
embryohaveinitsprenatalstages?”.meanswertothisquestiondirectly
drawsuponthelogicoftheentiretyofthelegislationconcerninghuman
biogenesisindetermininganysortofdefiniteresolutioninthisregard.

centralcomponentsoftheCouncilofEurope’shumanrightsprotection
