Introduction
Withaveryrecentexampleoffailureincompliancewithrequirements
ofCouncilDirective1999/31/ECof26April1999onthelandfillofwaste,
Slovakiademonstrateshowimportantitistofulfillobligationsunderthe
Europeanenvironmentallawandhowcostlyasinglecaseofnon-compli-
ancewithenvironmentalprovisionscanbe.InitsfirstjudgementinCase
C-331/11theCourtofJusticefound,that“byauthorizingtheoperationof
landfillsitewithoutasite-conditioningplanandintheabsenceofadefi-
nitedecisiononthecontinuedoperationonthebasisofanapprovedsite-
conditioningplanSlovakRepublichadfailedtocomplywiththerequire-
mentsunderArticle14a)toc)”1oftheabove-mentionedDirective,that
requiresMemberStatestotakemeasurestoensurethatlandfills,which
havebeengrantedapermitorwhicharealreadyinoperationatthetime
oftranspositionoftheDirective,maynotcontinueoperationuntilthey
prepareandpresenttotheauthoritiesfortheirapprovalaconditioning
planandtakecorrectivemeasures,ifneeded,inordertocomplywiththe
requirementsoftheDirective.
