intheSC’sobservationthat,inexceptionalcases,thechangeoflegalsexcould

beefectedwithoutaformersurgicalintervention,providedthattheactualsex

identityofthepersoninquestionispermanentandirreversible.

Asfarasthelowercourts’practiceisconcerned,the1978SCjudgmentpaved

thewaytothecorrectionoflegalsexinagrowingnumberofcases.Whatismore,

theexceptionenvisagedbytheSC-concerningthelackofadaptationsurgery

-did,infact,becomearule.Thisapproach,whileacceptedbypsychiatristsand

sexologists,whounderlinedthetherapeuticefectofthejudicialchangeofsexon

theirpatients,wassometimescriticizedbythelegaldoctrine.19

Anunexpectedhaltinthedevelopmentofthejurisprudenceconcerning

transpersonstookplaceanotherdecadelater.InitsjudgmentofJune22,1989,20

theSCproclaimed(solemnly)thattranssexualismisnotavalidreasontocorrect

thedesignationofsexinthebirthactoftheinterestedperson.Thefactthatthe

originalcivilstatusactshowedthebiologicalsexofachildinaproperway

(i.e.inaccordancewithexternalsexfeatures)precludedthepossibilitytouse

thecorrectionprocedures.Thelattershouldbereservedonlyforcasesinwhich

thecivilstatusactwasfaultyabinitio.Thejudgmentwashandeddownbythe

extendedpanelof7judgesanditwasomciallydeclaredtobea4legalrule’of

theSC.Suchrulesareenteredintoaspecialregisterandtheymustbefollowed

inthefuturebyother(regular)panelsoftheSC.Indeed,therestrictiveview

takenintheyear1989wassoonreiteratedinanextrulingoftheSCdated

May8,1992.21

5.3.Anewconcept–thewritforrecognition

Thefearsthatthejudicialchangeofsexwillnotbepossibleanymore

weredispelledinanotherjudgmentoftheSC,whichwashandeddownon

March22,1991.22Importantly,though,thisrulingadoptedacompletelynew

approachwithrespecttothesituationoftranspersons.Withoutchallenging

thelegalruleestablishedin1989,concerningtheinapplicabilityofthecivil

statusactcorrectionprocedures,theSCindicatedanalternativewayforthe

changeoflegalsex.Thesenseofsexidentityofanindividualwasdeclaredone

ofthe4personalgoods’-aspeciallegalcategorythatisprotectedbythelaw.
