Whateverpositionistakenwithregardtotheaboveproceduralissue,from

thesubstantivepointofviewitshouldbekeptinmindthat,asitwillbeobserved

below,thesheerfactofhavingchildrenand,especially,beingmarriedmaybe

seenasanegativeconditionforthechange-of-sexjudgment.

5.4.2.Thesecondcharacteristicfeatureofthecurrentconceptusedby

thePolishjudiciarytoprotecttherightsoftranspersonsconcernsthewayof

introducingtheinformationonthereassignedsexintotheCivilStatusRegister.It

mustbeunderlinedthatthejudgmentrecognizingthereal(psychological)sexof

theplaintifdoesnotleadtothecorrectionofthebirthact.Itonlyjustiﬁesmaking

anappropriatesupplementaryannotationwhichisputonthemarginofthecivil

statusactandwhichreﬂectsthechangeofthecivilstatusefectiveforthefuture.

Aftertheannotationismade,itisthe4updated’civilstatusofanindividualthat

willberevealedinallnewexcerptsissuedfromtheRegister.Thus,incaseof

transsexuals,anannotationconcerningtheirchangeofsex,onceintroducedinto

theoriginalbirthact,willmakeitpossibletoissuebirthcertiﬁcatesshowingthe

reassignedsex.Theshort(simpliﬁed)versionofthecertiﬁcatewillshowonlythe

currentdata,whereasthefullversionwillshowbothoriginalandnewdata(side

byside).

5.5.Theconditionsforthejudicialchangeofsex

Intheabsenceofclearstatutoryprovisions,theconditionsforthejudicial

changeofsexmustbeinferredfromthecaselawoftheSC(andcourtsoflower

instances).28Theseconditionsmaybedividedintoformalandsubstantiveones.

5.5.1.Theformalconditionsarelinkedwiththeproceduralrequirements.

Theinterestedperson,furthertoArt.189oftheC.C.P.,shouldﬁleawritfor

recognitionoftheirreal(psychological)sex.Itiscrucialthattheplaintifshould

correctlyindicatethedefendantparty.Thisroleisreservedforthechildrenand

spouseoftheplaintif(ifapplicable)orfortheplaintif’sparents(cf.remarks

in5.4.1above).
