medicalinstitutionsoferingprofessionalhelp.

Itmustbementioned,however,thatnotallproceduresareequallyaccessible

(eveninreturnformoney).Inparticular,thereexistsanimportantlegalandethical

problemconcerningadaptationsurgerieswhichareaimedatchanging(adapting)

theexternalsexorgansoftranspersons.Asitisdemonstratedinvariousstudies,

amajorityoftranssexualsfeeltobe4strangersintheirbodies’andtheyareready

totakevariousstepstoaddressthisproblem.Atleastapartofthetranssexual

populationexpressestheneedforafullsurgicaladaptation.36Still,itmustbe

rememberedthatthiskindofinterventionleadstoinfertility,whichresultis

irreversible.Consequently,itcanbeseenasanexampleofaseverebodilyinjury

inthemeaningofcriminalregulations.Incaseofsuchinjuriestheconsentof

theinjuredpersondoesnoteliminatethecriminalcharacteroftheact.Thus,an

adaptationsurgerymaybeseenasillegalevenifperformeduponaclearrequest

ofthepatient.Thatiswhy,forfearofcriminalprosecutions,doctorsoftendecline

toperformadaptationsurgeriesinPolandunlessajudgmentonthechangeof

sexhasbeenissued.37Thiscriminalcontextmayalsobeoneofthereasonswhy

judiciarydoesnotrequireasurgicalsexchangeinterventionasapreconditionfor

therecognitionofthe4real’psychologicalsex.38

8.Currentdiscussion

ThepresentsituationinPolandconcerningtherightsoftranssexualpersons

doesnotseemsatisfactory.Thechange-of-sexproceduresthatareappliedby

courtsarenotbasedonanyclearstatutoryregulations.Thejudicialactivism

attractscriticismsfrommanyangles.Firstly,constitutionalobjectionsareraised

withregardtotheroleofthecourts.Ithastobereiteratedthat,accordingtothe

PolishConstitutionof1997,caselawisnotavalidsourceoflegalrules.Secondly,

whatiscriticizedistheactualchoiceoflegaltoolswhich-afterprovisional
