onEuropeanUnion(TEU)(recital170).Furthermore,theEuropeanCommission
hasbeenentrustedwithexecutiveresponsibilities(recital167),aswellaswiththose
stipulatedinarticle290TFEU,i.e.therighttoadoptgenerallyapplicablelawsto
supplementoramendsomeinsignificantitemsoflegislation(recital166).
ConsideringthefactthattheEUlegislatorshavenotconfinedthemselvesto
themereadjustmentofthepersonaldataprotectionsolutionsthatexistedsofaras
requiredunderDirective95/46/EC9butinsteadtheyhavedecidedtorepealand
replaceitwiththeGDPRaswellastheextenttowhichthepowersdelegatedbythe
GDPRtotheEuropeanCommission,includingthoseofexecutiveandconstitutive
nature,havebeenexpanded,somefundamentalchangemusthaveoccurredinthe
fieldofpersonaldataprotection.Itisreflectednotonlyinthesolutions,institutions
andtoolsusedintheGDPR,butaboveallinthenewlyadoptedphilosophyof
personaldataprotectionandtheredefinitionofitsgoals.Atthesametime,such
changesmustafectthewayinwhichconceptssuchasdataprotectionandtheright
totheprotectionofpersonaldataaredefined,fornotonlythenotionofpersonal
databecomescentral,butalsothatofdata,whichcomprisesdatathatcannotbe
usedtoidentifythepersonitrelatesto.
ItisnotwithoutsignificancethattheGDPRisoneofthelegalactssupposed
toreformthepersonaldataprotectionpolicyaspartoftheEUdigitalsingle
market.10
Asindicatedinitswording,thee-PrivacyRegulationisalexspecialistothe
GDPR,sinceitrefinestheGDPRwithmoredetailsandinclusionofelectronic
communicationdatathatcanbeclassifiedaspersonal.Consequently,this
meansthattheGDPRcomprisesonlythoseaspectsofpersonaldataprocessing
whicharenotdirectlyreferredtointhee-PrivacyRegulation11.Thedecision
toreplacetheDirectivewiththeRegulationisjustifiedbythegoalofensuring
consistencywiththeGDPRandtheneedtoguaranteelegalcertaintyforusers
andcompaniesandpreventanydiscrepanciesininterpretationacrossMember
