observationalsoappliestopotentialconstitutionalstatutesconcerningthepro-
cedureforadoptingtheConstitution.
ClaimscouldbemadethatArticle235containsnoseparate,expressregula-
tionconcerningacompletechangeoftheConstitution.Itneedstobeobserved
thatthereasonfornotspecifyingtheprocedureforadoptingacompletelynew
Constitutionwasthefearofencouragingradicalchangesandthelegislator’s
wishtoensurethattheexistingConstitution’sstabilityisnotundermined,with
thetacitassumptionthatshouldtherebeasignificantneedtodoso,atotal
changewillbemadefollowingtheprocedureforpartialchanges,asthesumof
suchchangesnecessarytoamendtheentireConstitution,aspertheargument
aminoriadmaius.13
SomepoliticiansformulatethepostulateofacompletechangeoftheCon-
stitution,butsofar,nodraftshavebeenproposedinthisrespect.Nomajor
rulesandsolutionsthatwouldbethefoundationofthenewConstitutionhave
beenannounced.ItwouldbeverydiIculttofindanalternativeforthecon-
temporaryconstitutionalstandardsincludedinthecurrentConstitutionofthe
RepublicofPoland.14
AsregardstheparticipationoftheSenateinthesystem-formingfunction
oftheparliament,itsroleinthisrespectandintheprocedureofamendingthe
Constitutionisambivalent.Ontheonehand,theSenate’sfirmparticipationin
thisproceduretestifiestotherecognitionofitspositioninthelegalsystem.On
theotherhand,thisrecognitionisnotfull.misisbestseenwhencomparingthe
participationoftheSenateinthisfunctionoftheparliamentanditsparticipa-
tioninthelegislativefunction.meSenateisoneofjustthreeentitieshaving
system-forminginitiativewithrespecttopartialandfullchangesoftheConsti-
tution.15meelectiveexerciseofthisrightisimpossiblewhileanextraordinary
measure(e.g.,martiallaworastateofemergency)isinforce.Outoftheentities
withtherighttoinitiatelegislation,onlytwoofthemretain,inanunchanged
