thequalityoflawspassed,whichdoesnotmeanthattheSenate’srolecouldnot
befurtherrationalized.However,abolishingtheSenatewouldleadtoadrastic
decreaseinthequalityoflawspassed,resultinginincreasingtheburdenonthe
ConstitutionalTribunalbymakingitreviewstatutesfilledwithdefects.22
mecontrollingfunction–underArticle95oftheConstitution,control
overtheCouncilofMinisters(andonlytheCouncilofMinisters)isentrusted
totheSejm,whichcarriesoutthistasktotheextentspecifiedintheConsti-
tutionandthestatutes.merefore,thefunctionofcontrollingtheCouncil
ofMinistersrestswiththeSejmandiscomprisedreviewingandinspiring
theactionsofthebodiessubordinatetotheSejm.23meSenateisomittedin
thisrespect,and,inprinciple,theConstitutiondoesnotassignacontrolling
functiontotheSenateanditsparticipationinthecontrollingfunctionofthe
parliamentisverymodest.misisinlinewithdoctrinalassumptions.mecon-
trollingactivityoftheSenatetakesplaceduringitsplenarydebates,theactions
takenbyministry-relatedcommissions,ortheactionsofparticularsenators
thatfeatureelementsofcontrol.AsrepresentativesofthePeople,senatorsex-
ercisetherighttodemandinformationfromtherepresentativesoftheCouncil
ofMinistersinconnectionwiththelegislativeprocessestakingplaceinthe
Senate.24Someofthecontrollinginstrumentsthatcanbeusedwithrespect
tothemembersoftheCouncilofMinistersareprovidedforintheRulesof
ProcedureoftheSenate.25meseinclude,forinstance,senatorialrepresenta-
tions,whicharecloseinnaturetoparliamentaryquestionssubmittedbythe
membersoftheSejm,ortherightofsenatorialcommissionstodemandthat
therepresentativesoftheCounciloftheMinistersprovideinformation,ex-
planations,opinions,andmaterialsandactivelyparticipateinthemeetingsof
thesecommissions.
mefactthatthecontrollingrightsoftheSenatearespecifiedprimarilyin
theRulesofProcedureoftheSenatethatareadoptedasaresolutionoftheSen-
ateallowsconcludingthattheSenatesuleredfromacertaindeficitofthistype
