1991onhealthcareinstitutions27)28.Thecaseregardedthedoctor’srefusaltorefer
awomanforprenatalgenetictestswhenitwassuspectedthatthefoetussuffered
fromtheTurner’sdisease,inasituationwherethespousesalreadyhadonechild
bornwiththisdefect.Themotherofthechildcomplainedthatshewasdeprivedof
herrighttomakeaninformeddecisiontoterminatepregnancyandthatthedoctor
preventedherfromdoingsobydeliberatelydelayingmedicalprocedures.
Moreover,inthejudgementoftheEuropeanCourtofHumanRightsof
20thMarch2007incasefileno.5410/03AlicjaTysiącv.Poland29,AlicjaTysiąc
ledanapplicationagainstPolandregardingtheunjustifiedrefusalbythedoctors
(gynaecologists)toperformprocedureofterminationofpregnancydespiteserious
medicalreasons-herpregnancyanddeliveryofachildwereextremelyrisky,could
causeretinaldetachmentandlossofsight,whichwasconfirmedbythespecialists
(ophthalmologists).Despitebeingentitledtothelawfulterminationofpregnancy,she
wasforcedtocontinuepregnancyandgivebirthtoababyriskingherlife.TheECHR
confirmedthattheStatefailedtoputinplacetheproceduralmechanismnecessary
toenabletheapplicanttoexercisetherighttorespectforherprivatelife(shewas
forcedtofear,distressanddeprivedofdignity).Inthejudgementof30thOctober

RightsfoundthattherehadbeenaviolationofArticle8ECHR(concerningtheright
torespectforprivateandfamilylife)inrelationtothedeterminationofconditions
ofaccesstolegalterminationofpregnancy.TheCourtstatedthatthePolish
Governmentderivedtherightofthedoctorstorefuseprovisionofcertainmedical
servicesbyinvokingtheconscienceclause,infactallowedbythePolishlaw,from
thefreedomofconscienceandreligionguaranteedbyArticle9ECHR.Italso
addedthat,evenifso,theStateisobligedtoorganiseitshealthcaresysteminsuch
awaythattheexerciseofthisrightbythedoctorswillnotpreventpatientsseeking
medicalaidfromgainingaccesstotheservicestowhichtheyareentitled.Thecase
regardeda14-yearoldgirlwhosepregnancywasaresultofacriminalact.The
medicalpesonnelwhoseassistanceshesoughtwiththehelpofhermotherrefused
tocarryoutthelegitimateterminationofpregnancyshewasentitledto,aswellas
providedthemwithsomemisleadingandcontradictoryinformationregardingthe
medicalprocedureandnecessarydocumentation(e.g.whetherthecertificatefrom
