Telatesttrendsrelatedtosecuringadebtarecharacterizedbyaconsiderableincreaseinabstractand
dynamicelements.Adistinguishingfeatureofcontemporarykindsofsecurityforadebt,bothintheform
ofpersonalpropertyandapledge,isthattheyaremarkedlyremotefromclassic,lesscomplexjuridical
structuresandthatthereisatendencytocreatemorecomplicatedandabstractobjectsoflegaltransactions.
Asforpersonalsecurity,themodelofguaranteesisevolvingwithrespecttothefollowingaspects:
aguarantor’sdebt,generalguarantee,theconversionofbillofexchangeliabilitiesintoacivillawguarantee,
anotificationtoaguarantorofadebtor’sdelay,afuturedebtguarantee,thescopeofaguarantor’s
liabilityandtheaccessorinessofaguarantee,thescopeofaguarantor’sobjections,aswellasthelegal
implicationsofsubrogationandcumulativeliabilityforadebt.Asforinternationallaw,theseaspects
arebeingstandardizedandthelawisinfluencedbytheRomeIRegulation.Depositisstructurally
similartobidsecurity,anadvancepaymentorearnestmoney.Tecommontrendtoauthorizebanks
tocollectmoneyfortherepaymentofaborrower’sliabilitiesinducesalimitationofbanks’dominance.
Atrustaccountintheareaofpropertydevelopmentencountersobstaclesrelatedtoconsumercontracts.
Asforpledgerights,apledgeonthird-generationimagerightsandotherinformation-relatedrights
hasbeencreated.Also,apledgeonalloftherightsandresponsibilitiesofapartnerinapartnershiphas
beenintroduced.Teamendmenttomortgagebringsaboutaneedforstrengtheningtheprotection
ofapartmentbuyers,whereastheconceptof“adequate”securityforamortgagedebtrequiresthat
excessivesecuritybedefined.Changestotheaccessorinessprincipleprovideamotivationforclose
juridicalconnectionsbetweenaccessoryrightsandaprincipalrightorforfunctionalconnections
betweenindependentrights.Teformsofandquasi-obligationsarisingfromagreementsonestablishing
subintabulate(i.e.amortgagesecuredwithanothermortgage)requiretobeclarified.
