byarrogantaction.Thisarroganceisspreadingnotjustinthe
structuresofeverydaylifebutlikewiseinanalysescarriedout
undertheauspicesofacademicinstitutionsand,evenmore
so,bytheintellectualcirclesofinfluentialthink-tanks,serv-
ingasasupplybaseforpoliticians.Thepropagationofthese
positionsdoes,however,influenceprofoundlythesocialcon-
sciousnessandcontributetotheacceptanceoftheproposed
changesbysocietyatlarge.Paradoxically
,thiscoincideswith
atimewhensocialsciencehasatitsdisposalresearchtech-
niquesandmethodsofferingavarietyofwaystoavoiderrors
indiagnosisandworkoutsolutionswhichbenefitaparticular
society.Thesedevelopmentsinmethodology,combinedwith
increasingavailabilityofdata,facilitateboththeconducting
ofcomplexsociologicalandlegalinvestigationsandmobilis-
ingtheacademiccirclesandpoliticaldecision-makerstodevise
asolutionmostfittingthegivenplaceandtime.
Apartfromunderappreciatingempiricalresearch,social
scienceshowssignsofageneraldeteriorationoftheoretical
thought.Thistakesasignificanttollonthetheoryofcriminal
law,thequalityoflegalsolutionsthereofand,consequently,
oncriminalpolicy,thatisonthequalityofsocialpolicyinthis
sphere.Thisphenomenonhasbeennotedintheliteratureof
thesubject,whereitistreatedasasocialproblem,i.e.astateof
affairsseenasnegativeforthedevelopmentofscienceaswell
asthequalityofsociallifeingeneral.3Theinfluenceofschol-
arshiponcriminalpolicyisfurtherdiminishedbythefactthat,
toquotetheUScriminaljusticescholarsJamesQ.Wilsonand
