paragraphofthequotedregulationthatelaboratesontheprotectionof
thelegitimateinterestsrefersexplicitlytotheprincipleofproportionality.
CJEU,ontheotherhand,doesnotreferexplicitlytothisprinciple.The
courtruledsimilarlyinthecaseSTVmbH.v.BrangewitzGmbH5withref-
erencetoobligationfortheprocessortoproviderequestedinformation.
Therulingitselfrefersexplicitlytotheprincipleofproportionalityonly
inthereportofplaintiff’sarguments(para.31oftheruling,alsopara.10
oftheopinionofAdvocateGeneral6),butthethreadwasnotpickedupby
thecourtduringfurtherproceedings.Intherulingmentionedpreviously,
namelyC.Schulinv.STVmbH,CJEUbroughtupanothermatter,crucial
whenitcomestothefurtherreasoning.Itactuallyexpressedtheopinion
thatthefailuretopaytheremunerationbasedonagriculturalexemption
shallbetreatedastheinfringementoftheplantbreeder’sright(para.71
oftheruling).ThisstandpointwaslaterreaffirmedintherulingJ.Geist-

WhenitcomestotheDirectiveNo.2004/48,theclaimforinformation
isregulatedinArt.8(Preamblementionsthisprovisioninrecitals7and
21).Aspertheregulation:flMemberStatesshallensurethat,inthecon-
textofproceedingsconcerninganinfringementofanintellectualprop-
ertyrightandinresponsetoajustifiedandproportionaterequestofthe
claimant,thecompetentjudicialauthoritiesmayorderthatinformation
ontheoriginanddistributionnetworksofthegoodsorserviceswhich
infringeanintellectualpropertyrightbeprovidedbytheinfringerand/
oranyotherpersonwho:(a)wasfoundinpossessionoftheinfringing
