1.INTRODUCTION
Thetermflprototype”mightbeassociatedmostlywiththepatentlaw,
themainsubjectofProfessorMichałduVall’sresearch,however,asthe
titleofthispaper,itbearsametaphoricalmeaning.Thepaperfocuses
ontheplantvarietyprotectionlaw,whichisafieldcloselyrelatedtothe
patentlaw,hencewasalsotosomeextentwithinthescopeofProfessor
duVall’sinterest.
Itwasnotin2004,butadecadeprior,towitin1994,whentheclaim
forinformationwasintroducedintotheEuropeanCommunityintellec-
tualpropertylaw.ThisfactseemstobeomittedbybothPolishandfor-
eignlawscholars.Itwasatthattimewhentheaforementionedinstitution
wasincorporatedintolegislationconcerningplantvarietyrights,namely
inArt.14para.3,indent6ofRegulationNo.2100/941andArt.8–12of
theRegulationNo.1768/95.2Moreover,thisinstitutionbecameasubject
ofinterpretationinseveralrulingsoftheCourtofJusticeoftheEuro-
peanUnion(CJEU).Theobjectiveofthispaperistosuccinctlycompare
bothinstitutionsandtorefertheconclusionstotheinterpretationof
