fortheflcoaxing”useonly.Thereafter,itwasmentionedthattheclaim
considereddifferssignificantlyfromtheclaim,basedonArt.36bpara.1
subpara.2u.o.p.o.r.,toobligetheinfringeroftheexclusiverighttopro-
videtheinformationanddisclosethedocumentationmeaningfulforthe
claims,basedonArt.36bpara.1subpara.2u.o.p.o.r.(andtorequestthat
theevidencefromshouldbesecured,asregulatedinArt.36bpara.1sub-
para.1u.o.p.o.r.),andforthatreason,itcannotbestatedthattheprevious
infringementshallbetreatedasapremiseoftheclaimforinformation
basedonArt.23au.o.p.o.r.Induecourseofdeliberation,thecourtreferred
toclaimsforinformationestablishedbyotheractsrelatedtothePolishin-
tellectualpropertylaw,i.e.Art.47,80para.1pr.aut.,17andinparticular
Art.105para.2pr.aut.andArt.2861p.w.p.,18indicatingthat:flnoneofthe
legalconstructsmentionedimplementedthepremiseofsubstantiation
thattheexclusiverighthasbeeninfringed(asincaseofinjunctionpro-
cedure,Art.7301para.1k.p.c.19)”.Finally,thecourtreferredtotheliteral
wordingoftheanalysedregulation,whichdoesnotmakethepossibility
ofsubmissionoftheclaimforinformationconditionalontheexistence
ofanypremise.Moreover,itwasindicatedthatsuchinterpretationdoes
respecttheflguarantee”natureoftheregulationandtakesintoaccountits
mainpurpose,whichisovercomingtheobstaclesconnectedtothesub-
stantiationofuseoftheprotectedvarietiesbyfarmers,deriving,interalia,
fromthenumberandthestructureofPolishfarmsteads.Lastbutnotthe
least,thecourtconstatedthatthelowleveloflegalandsocialconscience,
