1.Theprincipleofthedemocraticruleoflawisthefoundation
oftheRepublicofPoland.OnemustagreewithWojciechSokole-
wiczthat,really,itcomprisestwointerrelatedprinciples-the
principleoftheruleoflawandtheprincipleofthedemocratic
state(Sokolewicz,2007,p.11).Theserelationshipsresultpri-
marilyfromtheindissolubilityofthetwoprinciplesincontem-
poraryconstitutionalism,although,accordingtoAndrzejPułło,
theinclusionoftheseprinciplesinoneregulationundermines
itsmeaningdirectinginacertainwaytheinterpretationofthe
ruleoflaw(Pułło,2014,p.47).Despitethis,itisdimculttoimag-
ineastategovernedbytheruleoflawthatisnotdemocratic
orademocraticstatethatisnotgovernedbytheruleoflaw.
Somecommentatorspointtotheasymmetryoftheseconcepts
andtheimpossibilityofademocraticstatefunctioningwithout
implementingtheprincipleoftheruleoflawwhilethereverse
isalsopossible(Tamanaha,2005,p.37).Becauseoftheserela-
tionships,analyzingthesetwoprinciplestogetherisabsolutely
necessary,evenifthehistoricaldevelopmentandthepremises
oftheseprinciplesaresignificantlydifierent.
Thegenesisoftheruleoflawliesattheendoftheabsolutemon-
archyperiod,whenthestatesofthetimebegantotransform
themselvesintomodernstatesbyimplementingliberalideas
inpoliticalandsocial-economicsystems.Althoughcertainele-
mentsoftheconceptoftheruleoflawcomefromAnglo-Saxon
thinkers,Germancultureisrecognizedasthebirthplaceofthe
conceptoftheruleoflaw.Thisdoctrineisseenasoriginating
fromeighteenthandnineteenthcenturyphilosophy,represent-
edby,aboveallothers,ImmanuelKantandWilhelmvonHum-
boldt(Valades,2002,p.8).Kantunderscoresforemosttheneces-
sityofprotectingthefreedomoftheindividual,andsoitfollows
