Introduction
Thepresentationofacompletecatalogofconstitutionalprinciples
isoneoftheissuesthatisaconstantsubjectofdiscussioninlegal
doctrine.Probably,itisimpossibletoassembleaclosedlistofprin-
ciples,onethatwouldwingeneralacceptance.Thisisaresult,inter
alia,ofthefacttheprocessofthecreationofsuchprincipleson
thebasisoftheaxiologyofthePolishConstitutionisnotyetcom-
plete,andanychoiceofthemostimportantprinciplesismade,
toalargemeasure,onthebasisofsubjectivecriteria.Thiscan,in
anycase,alsobeseenintherulingsoftheConstitutionalTribunal,
which,inderivingprinciplesfromthecontentoftheConstitution,
frequentlyindicatesnewelementsamongthem,andsometimes
evenbestowsthatstatusonfurthernormsoffundamentallaw.
Generallyspeaking,thehighlightingofprinciplescomesdownto
definingthemostimportantvalues,whichcanberecognizedas
theaxiologicalfoundationsoftheConstitution.Thetaskismade
additionallydimcultbythechangingpoliticalandsocialcondi-
tionsinwhichinterpretationandtheapplicationofconstitutional
normsbecomesessential.Consciousofthedimcultiesconnected
withanychoiceofthemostimportantprinciplesofthepolitical
structureofthePolishstate,theauthorsofthisbookdonothave
theintentionofbuildingaclosedcatalogofthoseprinciples.Rath-
eritisamatterofpresentingthereaderwiththosethatexpress
themostimportantfeaturesthatmarktheconstitutionalstructure
andlegalsystemofthePolishRepublic.Weaimtodiscussthose
thatmakeitpossibletoindicatethespecificfeaturesofthePolish
constitutionalsystem,attesttoitsidentity,andexpressthefunda-
mentalvaluesthatunderlietheshapingoftheconstitutionaland
structuralinstitutionsofthelegalsystem.
Thefundamentalprinciplesofthesystemaregathered,aboveall,
inthefirstchapteroftheConstitution.Theseformtheframework
