Wewillbeginwithafewcommentsontheverynotionofreligious
freedom,asitisanentirelymodernconcept.IntheteachingoftheCath-
olicChurch,itwasfirstrecognisedasapositivevalueintheDeclaration
onReligiousFreedomDignitatisHumanae.1Commonperceptionregards
itasanessentialelementofcivilfreedoms.
However,weneedtoraiseaquestionwhethertheconceptappliesto
thedescriptionoftherealityandtherulesofsociallifeinancientRome.
Forthesakeofdiligence,thetwoelementsofthephrasehavetobecon-
sideredseparately

Freedom.Romancultureand,consequently
,legislation,cherishedthe
notionoffreedom;inthelegislation,however,itwasnotexpressedas
anequalityofcitizensvis-à-visthestate,butonthecontrary
,asthedif-
ferentiationoftheirrightsandresponsibilitiesdependingonthesocial
classtheybelongedto.TheveryideaofRomanlawwasbasedonthe
recognitionthatthepowerofthestatewasnotabsolutetheRomans,
atleastthosewhowerefree,werecitizens,notsubjectsofanabsolute
