procedurecanbeinitiatedonlyasaresultofappealbytheparty,thereisno
possibilitytoinitiateproceedingsexofcio.Therighttoa.f.a.d.belongsnotonly
thepartywhoparticipatedintheproceedingsnalizedwiththedecision,but
alsotothepersonwhodidnotparticipateintheproceedings,butisaparty
withinthemeaningofc.a.p.Thelawsetsadeadlineforappeals,countingfrom
thedateofdeliveryofthedecisiontotheparty,andwhenthedecisionwas
announcedorallyfromthedayitwasannounced.A.f.a.d.aresubmittedtothe
competentappealbodythroughthebodywhichissuedthedecision;nodetailed
justicationisrequired,itissufcientiftheappealshowsthatthepartyisnot
satisedwiththedecisionissued.A.f.a.d.shouldmeetthegeneralrequirements

APPOINTMENToneofnon-contractualwaysofestablishinganemployment
relationshipalongsidenominationandselection.Theemploymentrela-
tionshiponthebasisofa.isestablishedforanindeniteperiod,andif,onthe
basisofspecialprovisions,theemployeewasappointedforaxedterm,the
employmentrelationshipisestablishedfortheperiodsetinthea.Theemploy-
mentundera.maybeprecededbyacompetitioneveninsituationswhenthe
specicprovisionsdonotprovidefortherequirementtoselectacandidatefor
thepostonlyasaresultofthecompetition.Accordingtothelabourcode,the
employmentonthebasisofa.isestablishedinthecasesspeciedinseparate
regulations,withinthetimelimitspeciedinthea.,andifthetimelimithasnot
beendecidedonthedayofservice,unlessspecialprovisionsstateotherwise.
Asageneralrule,theemploymentonthebasisofa.isgovernedbythepro-
visionsontheemploymentcontractforanindeniteperiodoftime,withthe
exceptionoftheprovisionsgoverning:theprocedureforterminatingemploy-
mentcontracts;dealingwithdisputesfromtheemploymentrelationshipinthe
partconcerningadjudicatingtheineffectivenessofdismissal,restoringtowork.
Theemploymentrelationshipestablishedonthebasisofthea.refersprima-
rilytopersonsinmanagerialpositions(e.g.,seniorcivilservantsareappointed
from2016),andbecauseofitscharacteristicsthemostunstableformofemploy-
ment,sincetheappointeecanbedismissedbytheappointingauthorityatany
time.Thisrulealsoappliestoemployeeswho,onthebasisofspecialprovi-
sions,wereappointedfortemporarypositions.Thedismissalmustbemadein
writinganddeliveredtotheemployeeasadocumentconrmingtheactivities
undertheemploymentrelationship.Thedismissalisequivalenttotermination
