TeEuropeanUnionasanareaoffreedom,securityandjusticehascreatedacom-
munitywhichadherestounifiedlaws.Inmattersregulatedbylabourlaw(indi-
vidualandcollective)aswellassocialsecuritylaw,theaboveaimmaybemetby
introducingunifiedregulations,allowingforidenticalwaysofresolvingconflicts
oflabourlawissuedinworkrelationswherethereisaforeignelementpresent.In
ordertoassurethelegalstabilitywithinworkrelations,nationalregulationscon-
cerninginternationalprivatelabourlawhadtobereplacedbyunifiedconflictsof
lawnorms.Tesenormsarethentobeappliedbybothemployeesandemployers
ofEUmemberstatesaswellasappliedinworkrelationssituations(individualor
collective)wheretherearethirdpartiesinvolved.EUprivateinternationallawis
acollectionofinternationalprivatelabourlawregulationsissuedbyEUinstitu-
tions,whichunanimouslyandinaunifyingfashiondescribethelegalsituations
ofthepartiestoaworkrelationship,wherethereisaforeignelementpresent,
allowingfortheapplicationofforeignlawsbasedoncitizenship,residency,where
theheadquartersofoneofthepartiesislocated,wheretheworkiscarriedout
orwheretheactionhastakenplace(e.g.theplaceoftheworkrelatedaccident).
Teunificationofsuchconflictoflawissues,whichresolveconflictsinwork
relationswherethereisanationallabourlawsystempresentaswellasaforeign
element(includingtheindicationoftherightfulcourttoresolvesuchconflicts),
assurestheequaltreatmentofEUcitizensandthirdpartynationalswhosesub-
jectscomeundertheEUlegislationwhenenteringlegalrelationshipsgovernedby
labourlaw.MostmemberstatesoftheEuropeanUnionhaveextensiveexperience
insettlingconflictsoflawinnationallegislationsusedforresolvingconflictsin
obligatoryissuesaswellasinlabourrelations.Tediferenceinviewbetweenthe
doctrineofprivateinternationallawandcourtdecisionsintheEuropeanUnion
MemberStates,whichstemfromarichtradition,havenotcreatedlegalcertainty
orassuredauniformtreatmentofthepartiesintheworkrelationshipwithinthe
EuropeanUnion.Inaddition,theexistenceofconflictoflawnormswithincer-
tainMemberStatesdonotregulatetheconflictrulesapplicabletoeventsthatare
notobligations.Foremostly,difcultiesaroseinsituationsofcollectivelabourlaw
standards,usedtodeterminethecompetenceoftheworkers’representatives,col-
lectiveactiontakenbythepartiestoindustrialrelationsinordertoexertpressure
ontheotherpartyduringthenegotiationsprecedingtheconclusionofacollective
agreementorotheragreementsgoverningthenormativerightsandobligationsof
partiestoworkrelations.
