Afertherewaspreparedanarticulatedwordingofthefirsttwoparts
ofthedrafoftheCivilCode,theministerPavelRychetskýauthorized
JUDr.MilošTomsa,CSc.toconductareorganizedrecodificationcommitee
whichdiscussedwiththeauthorstheproposedsolutionsandthushelped
bringanoptimalformthereoftocompleteness.Alreadyon17.5.2005,the
MinistryofJusticeintroducedtothepublicthefirstversionofthedrafof
thenewCivilCodeandcommencedpublicdiscussionwithrespectthereto.
InJuly2007,theMinistryofJusticeasked38independentexpertsfor
assessmentofthedrafwhetheritiseligibleforbeingsenttoacomment
procedure.Thisinformalcommentprocedurewascarriedintheconstruc-
tivespirit,avastmajoritysupportedtheintent,thoughwithanumberof
recommendationsandcomments.
TheMinistryofJusticedecidedonthefinishingofthedrafanddivid-
editintotenparts.Withrespecttoeachofthemitappointedagroupof
expertswhichtogetherwiththerecodificationcommiteesecuredcontinu-
ityandinterconnectionofindividualareas.Activityoftheminiteamswas
terminatedinMarch2008.Subsequently,thedrafwasbeingfinishedand
sentatthebeginningofJune2008tothecommentprocedure.
Afermanyperipeteia,theGovernmentoftheCRapprovedatitsmeet-
ingon18May2011adrafofthenewCivilCodebyitsresolutionno.357
andthedrafwasthensenttotheChamberofdeputiesoftheParliament
oftheCzechRepublicasparliamentaryprintno.362.Chamberofdeputies
approvedthedrafinthefirstreadingatits19thmeetingon8June2011and
orderedtheCommiteeofLegalandConstitutionalAfairstheconsideration
thereof.SenateoftheParliamentoftheCRconsideredthedrafofapro-
posedlaw,however,itdidnotadoptanyresolutionwithrespectthereto.
PresidentoftheRepublicsignedthenewCivilCodeon20February2012.
2.Docommercialobligationsstillexistin2014?
ThetermofcommercialobligationshasbeenproblematicintheCzech
LegalOrdersince2014withthearrivalofthenewCivilCode.Someeven
spokeofthattheCommercialLawasanindependentdisciplineceasedto
exist.Itwastobereplacedsolelywiththecorporatelawwhichwouldreg-
ulatetheLawofBusinessCompanies.Otherdisciplinesweretobedivided
intoothercategories7.LawofObligationsassuchnewlyfallsolelyunder
