stereotypicalunderstandingofnegotiationsingeneral,andlegal
hepresentvolumeconstitutesanattempttogobeyondthe
negotiationsinparticular.Thecommonapproachistotreat
negotiationsaseitherapurelyphilosophicalorapurelypsychological
phenomenon.Ontheformerview,negotiationsareconnectedwith
somechosenphilosophyofpersuasion;onthelatter–theyentirely
belongtothedomainofpsychology.Meanwhile,amorecareful
analysisoftheontologicalandepistemologicalfoundationsof
negotiationsrevealsthatthephenomenoninquestionalsohasother
dimensions,e.g.logicaloreconomic.Oneofthegoalsoftheessays
collectedhereistoilluminateallthementionedandotheraspectsof
legalnegotiations.
Thevolumeconsistsoftenchapters.Thefirstessay,Wojciech
Załuski’s“TwoConceptsofFormalJustice”,isdevotedtothe
analysisoftwoapproachestoformaljustice–understoodasthe
requirementofthecorrectapplicationofrulesontheonehand,andas
aruleregulatingthewayofdealingwithunequalcasesontheother.
Bothconceptsarerelevantforanydiscussionconcerningaxiological
controversiesinanytypeofnegotiations.ThenextchapterisMarta
Soniewicka’s“BargainingValues:FromaMarketEconomyto
aMarketSociety”.Itdescribesthetensionbetweenfreedom,equality
andfairness,andconstitutesaperfectpointofdeparturefor
discussingtwodifferentapproachestolegalnegotiations:economic
andfairness-based.
Theproblemoftimeisrarelyaddressedintheliteraturepertaining
tolegalnegotiations.JolantaJabłońska-Bońca’sessay“Tempusfugit”
isanattempttofillthisgap.Theauthoraddressestheproblemoftime
inlegaldiscourseandinthecommunicationprocessesingeneral,and,
onthebasisofthoseconsiderations,analyzesindetailthequestionof
timeinlegalnegotiations.WojciechCyrul,inhis“LegalNegotiations
intheInterculturalContext”,providesaculturalandsociological
perspectiveonnegotiating.Headdressesthequestionofnegotiation
