ThisisagroundbreakingcasefortheTribunalsinceitisthefirstoneithas
receivedonthedelimitationofmaritimedisputes.Thewrittenproceedingsarewell
underwayandwillconcludebynextJuly,afterwhichoralproceedingswillfollow
stillinthecourseofthisyear.
Case18,betweenSaintVincentandtheGrenadinesandSpain,relatesto
arequestforcompensationforallegedillegaldetentionofvessels.
MrPresident,
ThejudicialworkoftheTribunalisspeciallycreditedwithbeingtime-
effective,andrightlyso.TheTribunalhasdevelopedacase-managementpractice
thatavoidsunnecessarydelays.The“SAIGA”-2Case-acaseonthemerits-took
lessthantwoyearstoberesolved.Likewise,Case16,betweenBangladeshand
Myanmar,andCase18,betweenSaintVincentandtheGrenadinesandSpain,will
beresolvedwithinasimilartime-frameinaccordancewiththerespectiveorders
issuedontheconductofthecase.Ontheotherhand,allthecasesofpromptrelease
andprovisionalmeasuresentertainedhavebeenresolvedwithinatime-frameof
lessthanamonth.
TheroleplayedbytheTribunalintheoveralllawoftheseadispute
settlementsystemgoesbeyonditsjudicialrole.AnnexVIIoftheConventionsets
outthegroundrulesfortheestablishmentofarbitraltribunalstowhichStatesmay
refertheirlawoftheSeadisputes.ThePresidentofITLOSisgivenavery
importantauthoritybyarticle3ofthatAnnextoappointarbitratorsattherequest
ofoneofthepartiestoadisputesubmittedtosucharbitraltribunals,wheneverthe
partiesdonotagreeonthechoiceofarbitrators.Partieshave,onoccasion,sought
andbenefitedfromtheassistanceofthePresidentoftheTribunalinthisregard.
2.Theapplicablelaw
YoumaywishtoknowwhataretherulesappliedbytheTribunalindealing
withthesecases.Iwillattempttogiveyouabriefaccountofthedifferentsetsof
rulesofinternationallawthattheTribunalhasappliedinitscase-law.ThenIwill
narrowdownmyobservationstohighlightthecircumstancesinwhichtheTribunal
hasmadeuseof“theotherrulesofinternationallawnotincompatiblewiththe
Convention”asreferredtoparagraph1ofarticle293oftheConvention.
TheConvention,asmaybeknowntoyou,providesanextensiveinterna-
tionalregulationofthelawofthesea.Itincludesrulesofcustomarylaw,aswellas
severalnewprovisionsreflectingtheprogressivedevelopmentinthisfield
achievedduringitsnegotiationsattheThirdUnitedNationsConferenceonthe
LawoftheSea.
ByapplyingtheConventiontoaconcretecase,theTribunalappliesnotonly
thenewtreatyprovisionsthatitcontains,butalsothegeneralinternationallawthat
itcodifies,aswellasrulesandstandardsfoundinagreementsofatechnicalnature
thathavebeenabsorbedbyitthroughreferencestothoseagreementsinseveralof
