entirety.AsitappearsinmeConvention,thewordKeveryone”isusedto
representeverymemberofthehomosapienssapiensspecies,inreference
totheperiodoftimebetweenbirthanddeath.Ifoneconcludesthatthe
limitednatureoftheaforementionedperiodduringwhichrulesprotecting
humanlifeisapplicable,onewillfindamanifestcontradictionbetween
theexplicitcontentofstandardsassetoutinArt.1oftheECHR:Kme
HighContractingPartiesshallsecuretoeveryonewithintheirjurisdiction
therightsandfreedomsdefinedinSectionIofthisConvention”;thecon-
tradictionbeinginmeConvention’sphilosophicalnatureandtherefore
thegoalsimpliedtherein.PartiesreferredtoinmeConventionarethus
responsibleforanybreachinlawsprotectingtherightsandfreedomsofall
individualsfallingunderthejurisdictionofsaidConvention12.

dividualsborninaccordancewithinthejurisdictionofmeConvention,
wouldappeartobeanexampleofacontralegeminterpretation;however,
anyhypothesiswhichbroadensthisrangeofindividualsintotherealms
ofthoseinaprenatalstateofdevelopmentseemsnot,however,tobreak
anyoftheethical,axiologicalandlogicalcoherenceoftreaty’sspecific
regulations.Recognizingthatpartiesadmitliabilityforensuringallthe
rightsandfreedomsmentionedinmeConventiontoeachindividual
fromthemomentofconceptiononwards,therebyacceptingthatthe
righttolifeshouldalsobeaccordedtohumanembryosandfoetuses,is
innowayindirectcontradictionwithmeConvention’sregulations13.
