Fromtheperspectiveofthehardcasestheory,thereis
stilltheproblemofmaintainingspecifichomeostasisbetweentherightto
protectinterestsresultingfromintellectualactivityandthefreedomtouse
itsresultsortherighttohealth.Itisparticularlyimportanttodiscussthe
possiblerangeofrestrictionofintellectualpropertyrightsresultingfrom
theneedtoprotectpublicinterestorensurethepreeminenceofhuman
rightsprotectionoveragreementsandeconomicpoliciespertainingto
intellectualpropertyprotection.37
Duetoitsmassivescale,themostillustrativeexampleofthisproblem
istheHIV/AIDSpandemic;38however,itshouldbenotedthatalmost650
thousandpeople-thevastmajorityofwhomareresidentsofAfrica–die
