Abstract:On4thFebruary,2011,PolishParliamenthasenactedtheactonprivatein-
ternationallaw,whichwaspublishedintheOfficialJournalNo80,item432,andcame
intoforceon16thMay,2011.Thenewlawhasreplacedtheoldstatutefrom1965.Itcon-
stitutesthe“nationalpart”oftheconflictoflawrules,whichareinforceinPoland,and
iscoordinatedwiththeEuropeanprivateinternationallaw.Theactgovernsthematters
excludedfromthescopeoftheregulationsRomeIandRomeIIandsupplementsthe
Hagueconventionof19thOctober,1996onJurisdiction,ApplicableLaw,Recognition,En-
forcementandCo-operationinRespectofParentalResponsibilityandMeasuresforthe
ProtectionofChildren.Thenewlawalsoimplementstheconflictoflawruleestablished
inDirective2008/122/ECof14thJanuary,2009.
Theactof2011fillsoutmanyofthegapsthatexistedpreviously(e.g.itdetermines
thelawapplicableforthepowerofattorney,thepersonalrightsandthename)andalters
certainofthesolutionsadoptedunderthelawof1965.Itpermits,interalia,achoiceof
lawforthematrimonialpropertyregimes,themarriagecontractandthesuccession.
Moreover,theobligationsarisingoutoftheunilaterallegalactshavebeentreateddif-
ferentlythaninthelawof1965.Aswithrespecttotheformalvalidityofthelegalacts
relatedtothedispositionsoftheimmovablepropertyorthecorporatematters(suchas
thecreation,transformationorliquidationofthelegalentity),thenewlawgivesupthe
ruleaccordingtowhichitwassufficienttosatisfytherequirementsoftheformofthe
lexlociactus.
Finally,theactestablishesageneralrule,basedontheconceptoftheclosestconnec-
tion,whichapplyinthecircumstanceswheretheactitselforotherprovisionsofPolish
lawfailtoindicatethegoverninglaw.
