3.MotivesforchoosingAfghanistanasaresearchsubject

ThechoiceofAfghanistanandthesystemofpublicprocurementthereinby
theauthorassubjectsofanalysisisnotrandom.Between2008and2011,while
workingfortheCommonSecurityandDefencePolicy(CSDP)mission,the
authorparticipatedinworkundertakenbytheAfghanpublicadministration,the
objectiveofwhichwasreformofthesystemofpublicprocurement.Previously,
whileworkingfortheUnitedNationsDevelopmentProgramme(UNDP)as
alegalexpert,theauthorwasresponsiblefortechnicalsupportforreformofthe
systemofpublicprocurementinMalawi.Duringthisperiodshewasable,for
thefirsttime,toobserveinternationalengagementinthedistributionofpublic
fundsandinthecoordinationofinternationalassistance.Inallofthesecases,
theauthorhaddirectaccesstothepersons,documents,andinstitutionsinvolved
inreformingthesystemofpublicprocurement.Withoutsuchexperience,the
preparationofthispublicationwouldnothavebeenpossible.
4.Theaimoftheresearch,itsthesis,andthespecificissuesidentified
Principalaimoftheresearch:analysisofasystemofpublicprocurementas
ameansofstate-buildinginapost-conflictsituationrequiresthedetermination
ofthemannerinwhichregulationofpublicprocurementinpost-conflictstates
functionsinpracticeandhowitimpactstheeffectivenessoftheexecutionof
internationalassistance.SpecificattentionispaidtoAfghanistan,which,in
recentyears,hasbecomeapriorityaidrecipientandwhere,followingthefallof
theTalibanregime,67reformofpublicprocurementhastakenplacebasedonthe
UNCITRALmodellaw(1994).
Inordertoconductananalysisoftheimplementationoflegalnormsin
theareaofpublicprocurementinpost-conflictstates,itisnecessarytodiscuss
theircontent,tospecifythesourceoftheiroriginandtheactorsapplying
them,andtoexplain,basedoninternationallaw,thefactorsthatinfluence
theirimplementation.Alloftheseelementsareintegralpartsoftheanalysisof
theapplicationoflawinpractice.Theircomplexpresentationmayimpactthe
preparationofnewinternationalmodelsolutionsandcontributetoanincrease
intheeffectivenessofthesaidassistance.
