Introduction
anexplanationastohowconflictisdefinedintermsofinternationallaw,as
wellasamethodofidentificationwithregardtomeasuringitsoccurrence
andthelevelofitsintensity.Sincegeopoliticalfactorsimpactthepractical
implementationofregulations,suchathesisrequiresadiscussionofthe
specificityofthisphenomenonfromintrastateandregionalperspectives.
(2)State-buildinginAfghanistanisaprocesswhichhasbeendrivenby
internationalactorssince2001.Forthem,suchexternalassistance
constitutesaninstrumentfortheachievementoftheirobjectivesand,as
such,isconditionedbythem.Recognisingastateasbeingpost-conflict
enablesthespecificationoftypesofexternalassistanceandtheinternational
actorshelpinginstate-building.Asaresult,itpermitstheidentificationof
theregulationsintheareaofpublicprocurementwhichareappliedtothe
transferenceofaid.
(3)Modellawsintheareaofpublicprocurementconstituteaformof
internationalassistance.Theapplicationofmodellawsconstitutesan
elementofreformofthesystemofpublicfinancewithinstate-building.The
openingofthepublicprocurementmarketbearseconomicsignificance.
Fromtheperspectiveofinternationalactors,theadjustmentofnational
regulationstointernationalstandardsenablesforeignentitiestoaccessthe
domesticmarketofthestatebeingrebuilt.Thedraftingandsubsequent
transferofmodellawsconstituteaformofinternationalassistancewith
theaimofaccessingthemarket,and,asaconsequence,increasingits
competitiveness.
(4)Themodelprocurementlawsproposedbyinternationalactorsarenot
alwayssuitableinstrumentsforpost-conflictstates.Thespecificsofsuch
statesrequirethatlegalregulationsintheareaofpublicprocurementshould
beadjustedtothecontextinwhichtheyaretobeapplied.(One-size-fits-all,
solutions,althoughconsistentwithinternationalstandards,arenoteffective
becausetheydonotcorrespondtotheneedsofthepost-conflictstateand
donotallowforsustainablefulfilmentofitsfunctions.
(5)Thetransferofmodellawsintheareaofpublicprocurementoccursat
astagewhichisprematureinregardtostate-building.Thepost-conflict
stateisatthebeginningoftheprocessofbeingrebuiltandrequiresthe
adjustmentofinstrumentsofinternationalassistancetotheprevailing
conditions,includingtheexistingcapacityofstateinstitutions.Prematurely
transferringmodellawsintheareaofpublicprocurementdoesnotallowthe
statebeingrebuilttotakefulladvantageofinternationalassistance,andthus
mayweakenitseffectiveness.
Specificresearchissues:inthecourseofanalysisseveralissueshavebeen
