Introduction

However,inthecourseofthisdevelopment,noonespeaksofthesustainability
ofthesystem,itsself-reliance,oritsindependencefrominternationalactors.
Forthisreason,anattemptismadetoanalysetheeffectivenessofinternational
assistanceandhenceofpublicprocurement.
Inordertodiscusstheabove-mentionedissueslucidly,thepublicationis
dividedintoninechapters.InChapterOne,theconceptofstate-buildingis
discussed,includingthefunctionsthatthestateshouldfulfil,aswellastheability
ofinternationalactorstotakeupthischallenge.InChapterTwo,terminology
relevanttotheconditionsforrebuilding,suchas(conflict,and(post-conflict
situation,,isdiscussed.Moreover,anattemptismadetoanalyseAfghanistan
asapost-conflictstateinwhichabuildingprocesshasoccurred.ChapterThree
referstothescope,types,andmeansofsupportprovidedtopost-conflictstates,
usingAfghanistanasacasestudy.Theaimofthissegmentistoanalysethe
phenomenonofinternationalassistanceanditsdistributionthroughpublic
procurement.InChapterFour,considerationofexternalassistancecontinues,
butfromtheperspectiveoftheroleitplaysinstatedevelopmentandits
significancewithregardtotheeffectivenessofstate-building.
Furthermore,themainguidelinesininternationaldocumentsonthe
effectivenessoftheassistanceprovidedareconciselydiscussed.Attentionis
alsopaidtothescopeofusingpublicprocurementasamethodofdistribution
ofexternalresourcesanditsuseasatoolofinfluencebyinternationalactors.
InChapterFive,anattemptismadetoanswerthequestionofwhetherpublic
procurement,apartfrombeinganinstrumentusedforthedisbursement
ofdevelopmentresources,constitutesaformofinternationalsupportto
post-conflictstates.Themeansbywhichprocurementisregulated,includingthe
UNCITRALModelLawonProcurementofGoods,ConstructionandServices
(1994),arediscussed.InChapterSix,thestagesofdevelopingprocurement
regulationsinAfghanistanarepresentedfromahistoricalperspective,
encompassingtheperiodbetween1988and2007.Theproposedtimeframe
reflectsthemainstagesofdevelopmentofthissystemanddoesnotnecessarily
correspondtopoliticaleventsoccurringinAfghanistan.
Threeconsecutivechapters(seven,eighthandninth)arerelatedtothelaw
ofpublicprocurementcurrentlyinforceinAfghanistan,butarepresentedfrom
threedistinctlydifferentperspectives.InChapterSeven,analysisoflegislation
inforceatthetimeofresearchisundertakeninordertoverifyitsinternal
consistencyandcompleteness.AcomparisonismadewiththeUNCITRAL
ModelLawonProcurementofGoods,ConstructionandServices(1994),
consideredtobetheinternationalstandardinthisarea.Adetailedevaluationof
thedifferencesbetweentheAfghanlegislationandthemodellawfacilitatesthe
verificationofitscompliancewithUNstandards.InChapterEight,anin-depth
