Suchgeneraldoubtsmaybeexpressedwiththehelpofarangeofdetailedques-
tions,ofwhichIwouldliketodiscusssix.Therstconcernswhatisbioethics
andthesecondfocusesonwhatkindofrelationsmayexistbetweenscientific
truthsandethicalargumentsinbioethicaldiscourse.Thethirdcentresonthe
existenceofanadequatetheoryofbioethics,thefourthontheaxiologicalclosed
oropennatureofbioethicaldiscourse,thefifthontheparadoxofbioethicsand,
finally,thesixthdealswiththelimitsoflegalregulationofbioethicalproblems.
Anattempttoanswerthesequestionsshowsthatbioethicaldiscoursebecomes
morecoherentandtransparent.Ifweavoidsuchanattemptthenweabandon
anychanceofunderstandingfundamentalmatters.Anunavoidableconsequence
ofsuchanavoidancewouldbetoshapebioethicaldiscourseasaseriesofunre-
latedmonologues(whichwehavebeenabletoobserveforquitesometimeinthe
bioethicaldebateinPoland).
Thuswhatdowenotknowaboutlegalbioethics?
1.Dowenotknowwhatbioethicsis?
Thedebateastowhatbioethicsactuallyconsistsofhasadeeperdimension
notonlylimitedtodefinitions.Forsome,bioethicsissomekindof"neworder,”
ahighlyspecialisedfieldofscientificandethicalreflectionwhichhasarisento
meettheconcreteneedsofcivilizationasaresultoftheremarkableprogressof
scienceandtechnology,especially,insucheldsofknowledgeasbiology,me-
dicineandpharmacology(but,obviously,notonlythese).Forothers,however,
bioethicsisjusta"newword”and,intheeyesofitsadherents,thispositionstates
thateverythinghasalreadybeendiscussed.Thisconvictionhassomeappealing
andstrongarguments.Issuessuchasmankind,hisnature,freewill,selfrespect,
responsibility,aswellasmanyotherdetailedproblemssuchaseuthanasiaorthe
deathpenalty,havebeendiscussedinphilosophyinourculturalcontextsince
foreverand,furthermore,thosewhohavewrittenonthesesubjectshavebeen
the"greats.”Whatexiststhenincontemporarybioethicsorlegalbioethicswhich
isnew?Onlycertainaspectsofgeneticresearchhavebeendiscussed,suchasthe
abilitytocloneandinvitrofertilisation.Isthisenoughtofoundanentirelynew
academicdiscipline?
Whetherornotwehaveatleasttwooptions.Eitherweoptforthenarrowerno-
tionofbioethics,connectedwithacertaintypeofreflectionconcerningconcrete
examplesof"appliedbioethics”orweplumpforthebroaderconception,supported
byaphilosophicalandethicalbasis.Eachoftheseapproacheshasitsprosand
cons.
Inthecaseofthefirst,wegaintheabilitytoanswerconcretequestionswhich
ariseineitherbioethicsormedicine.Weareabletoconstructacertainappli-
cable"summarytheory”connectedwithadefinedeldofresearch,thelimitsof
knowledgeonagivensubjectandconcrete"difficultcases.”Repeatedlyappeal-
