thefifthcenturyCodexIustinianusalsooffersover70fragmentsreferringdi-
rectlytovicars,withapproximatelyone-seventhissuedinthefifthcentury,
andonlyonedatingfromthesixthcentury.65Foreditorialreasons,thefrag-
mentspreservedinbothcollectionsarereferredtointhisworkasconstitutions.
Nevertheless,itshouldberememberedthatonlyapartofNovellaePosttheodo-
sianaeandNovellaeIustinianiaswellassuccessorsofthecodeshavesurvivedin
theirentirety.Thelattertwosetsofsourcesmentionorrefertodiocesanadmin-
istratorsdirectlyoneightoccasions.66
Asobservedabove,theanalysisfollowsthearrangementofcontent
adoptedinCodexTheodosianusandCodexIustinianus;intheformercase,it
includestheinterpretationintheformofprivateinterpretationes,whichare
likelytohavebeendraftedtowardstheendofthefifthcenturyinGaul,with
itsreferencestoanalysedtextsofconstitutionsintheso-calledlegesRomanae
barbarorum67,aswellastoInstitutionesIustinianiand,toasmalldegree,tothe
ByzantineBasilika.68
TheorderofconstitutionsinCodexTheodosianusandCodexIustinianus
wasdictatedbypracticalconsiderationand,toalargeextent,duplicatedthe
