Introduction
Whileitwouldbeuntruetoclaimthatresearchonthediscourseofjudges
-andinparticularjudicialargumentation-isterraincognita,thefactremains
that,untilrecently,ithadattractedmostlylegalscholarsandphilosophers.In-
deed,thereisaplethoraofworksdealingwithjudicialdeductiveprocessesand
legitimisationofjudicialdecision-makingasseenbylegalpositivismornatural-
lawdoctrines.Ontheotherhand,studiesdealingwiththelinguisticconstruction
ofjudicialargumentation,intendedaschannelsthroughwhichcourtsresolve
disputesandjustifytheirdecisions,alsoofferinterestinginsightsintothe“ju-
dicial”natureofthediscourseofjudges,andassuchtheymaybeofinterestto
linguistsandlegalscholarsalike.Analysingthelanguageofjudgmentsfrom
adiscourse-pragmaticperspective,language-orientedaccountsofjudicialrea-
soningaim,ontheonehand,torevealwhatlinguisticdevicescourtsemployin
ordertoestablishandreinforcetheirauthorityand,ontheother,todetermine
whatcontextualfactorsaffectthechoiceofparticularlinguisticconstituents.
Highlightingtheinterfacebetweenlinguisticsandthelaw,thisbookaims
toprovideadiscourse-pragmaticperspectiveonjudicialargumentationand,
morespecically,toattemptanexplanationofhowandwhyjudgesrelyon
acertaindiscourserelationintheargumentativeportionofjudgments.Unsurpris-
ingly,thesaidrelationofConcession,oncereferredtoas“themostinteresting
achievementofhumanintellect”(Rudolph1996:385),iswidelyusednotonly
ineverydayargumentativeexchanges,butalsoinspecialisedwrittendiscourse,
includingthatproducedbyseasonedarguerssuchasjudges.Needlesstoadd,itis
ausefulstrategictoolenablingcourtstopositionfavouredargumentswithrespect
todispreferredones,withaviewtoresolvingthecasependingbeforethem.
Theconceptofconcessivityitself,withthegureofadmittance-theGreek
paromologiaortheLatinconcessio-asitspredecessor,haslongbeenthesub-
jectofnumerousinvestigations.Naturally,theunderstandingofthisphenom-
enonhasevolved,ashavelinguistictheoriesandconceptualparadigms.Follow-
ingamoregeneraltrendtowardsanalysesofnaturallyoccurringdataratherthan
idealisedanddecontextualisedexamples,recentstudiesonConcessionaccount
forcontextualfactorsandstressthedialogicandinteractionalnatureofthis
languagephenomenon.Yet,despitetheprofusionofpublicationsdealingwith
linguisticvariation,alsoacrosslegalgenres,therealisationofConcessionin
judicialdiscoursehasnotbeenattendedtoand,further,todatenoresearchhigh-
lightingtheroleofthisrelationinthelanguageofjudgeshasbeenundertaken.1
