1iPriortoproceedingtosea,themastershallensurethattheintendedvoyage
hasbeenplannedtousetheappropriatenauticalchartsandnauticalpublica-
tionsfortheareaconcerned,takingintoaccounttheguidelinesandrecom-
mendationsdevelopedbytheOrganizationi
2iThevoyageplanshallidentifyaroutewhich:
i1itakesintoaccountanyrelevantships’routeingsystems;
i2iensuressufficientsearoomforthesafepassageoftheshipthroughoutthe
voyage;
i3ianticipatesallknownnavigationalhazardsandadverseweathercondi-
tions;and
i4itakesintoaccountthemarineenvironmentalprotectionmeasuresthatap-
ply,andavoids,asfaraspossible,actionsandactivitieswhichcouldcause
damagetotheenvironmenti
3iTheowner,thecharterer,orthecompany,asdefinedinregulationIX/1,op-
eratingtheshiporanyotherpersonshallnotpreventorrestrictthemaster
oftheshipfromtakingorexecutinganydecisionwhich,inthemaster’spro-
fessionaljudgement,isnecessaryforsafenavigationandprotectionofthe
marineenvironment[32]i

The1978STCWConventionwasthefirsttoestablishbasicrequirementson
training,certificationandwatchkeepingforseafarersonaninternationalleveliPre-
viouslythestandardsoftraining,certificationandwatchkeepingofofficersandrat-
ingswereestablishedbyindividualgovernments,usuallywithoutreferencetoprac-
ticesinothercountriesiAsaresult,standardsandproceduresvariedwidely,even
thoughshippingisthemostinternationalofallindustriesiTheConventionprescribes
minimumstandardsrelatingtotraining,certificationandwatchkeepingforseafarers
whichcountriesareobligedtomeetorexceedi
