PolishConstitutionwhereitisstatedthateveryoneshallhavetherighttolegal
protectionoftheirprivateandfamilylife,oftheirhonourandgoodreputationand
tomakedecisionsabouttheirpersonallife.Therighttomakedecisionaboutone’s
personallifeisexplainedasfreedomtodecideforoneselfandone’slifewithout
anythirdpartyinterference,wherestateandprivateentitiesareobligednotto
infringethisfreedomandnottointerfereinthespheredefinedbyit,especially
whenanindividualmakesadecision;itisalsoperceivedasakindofrighttobe
letalone9.Theterm“righttoself-determination”directlyappearsintheLawof
12thMarch2004onsocialaid10initstwoprovisions-Article45clause3and
Article119clause2inrespectofthesocialwork(er).Inthiscontextitissaid
thatself-determinationexpressestherealisationofthepostulateoftreatinghuman
beingsassubjectsandnotasobjectswhoareguidedbytheirownrationale11.

IntheRecitalstotheLawof7thJanuary1993onplanningfamily,protectionof
humanfoetusandconditionsofadmissibilityofpregnancytermination(hereinafter
referredtoas“Lawonplanningfamily”)12themainfocusisputonsuchvalues
ashumanlifeconsideredasfundamentalwealthofaman,aswellasitisstressed
thatcareforlifeandhealthbelongstothebasicdutiesofthestate,societyand
citizen.Article1ofthisactprovidesforthattherighttolifeisprotectedbythe
