prenatalstage,cannotbedifferentiatedandthattheprotectionofmaternitycannot
beunderstoodasaprotectionrealisedexclusivelyfromthepointofviewofthe
interestsofamother/apregnantwoman.Initsview,thecircumstancesallowingthe
terminationofpregnancy,mentionedinArticle4aclause1point4oftheLawon
planningfamily,namelythe“hardlifeconditions”(comprisingmaterialsituation
connectedwithpregnancyanddeliveryofachild)or“difficultpersonalsituation”
ofapregnantwoman(acertainmentalstateregardingthefactofpregnancy)
wereextremelyvagueintheirnatureanddidnotrelatetotheextremesituations
becauseitseemedasifontheirbasisapregnantwoman(mainly)wantedtokeep
acertainmaterialstatuswhichcoulddeteriorateormissthechancetoimprovedue
tothepregnancyanddeliveryofachild.Thesestatementswerearguedinthree
dissentingopinions.
AccordingtojudgeZdzisławCzeszejko-Sochackiterminationofpregnancy
duetotheso-calledsocialconditionsisoftenadramaticdecisionofamother,
dictatedbyherconcernforthefateofherchildandsuchmotivationcannotbe
simplified.Therefore,theprerequisitesmentionedinArticle4aclause1point4
oftheLawonplanningfamilycannotbetreatedinsubjectivecategories.The
positionoftheTribunalwascategoricalandimposedonwomenadutytogive
birthandraiseachild.Therewasnoreferenceintherulingtothedignityand
freedomofawoman-shewastreatedinstrumentallywhilethediscussionshould
notevolvearounddifferentiatingthevaluesoflifebutaroundtheintensityofthe
legalprotectionofsuchlife.
AspointedoutbyjudgeLechGarlicki,thelifeofafoetuswillalwaysbeso
closelyconnectedwiththemother’sorganismthattherealisationofherright
tolife,health,dignity,privacyorfamilylifewillhavetoinfluenceitssituation,
however,thisdoesnothavetomeanthattheunbornlifehasalowervalueor
shouldberegardedasa“second-classlife”.Thejudgealsoreferredtothesocial
situationofapregnantwomanandherfamilysuchasextremepoverty(e.g.having
amulti-childfamilymaycauseseriousproblemssuchasbeingunabletoworkdue
tothenecessityoftakingcareofthechildrenandprovideforthefamilymembers,
whichmayresultinhungeranddesperation)whichmayleadtotheappearanceof
heavyconflicts.Awomanshouldnotberequiredtomakesuchsacrificesforan
unbornlifethatdrasticallyexceednormalstandardofexpectationsthroughtheuse
ofcriminallawmeasures.Thewholemattershouldnotbereducedtoawoman’s
financialstatus.
