I.Roleandlegalstatusofwomen
However,noneoftheseRegulationsdirectlymentionmedicallyassistedreproduction
procedures,insemination,invitroorotherspecialformsofinfertilitytreatmentas
formsoftreatmentfinancedbytheStatefromthepublicfunds.Presently,according
totheArticle48clause1oftheLawof27thAugust2004onhealthcareservices
financedfrompublicfunds34,healthprogramsmaybedeveloped,implemented,
executedandfinancedbytheNationalHealthFund,andhealthpolicyprograms
maybedeveloped,implemented,executedandfinancedbyministersandlocalself-
governmentunits.TheFundimplementshealthpolicyprogramscommissionedby
theministerresponsibleforhealthmatters.Itisindicatedthatthetypeandscope
ofsuchprogramsdependsontheresourcesofthelocalself-governmentswhilethe
safetyandclinicaleffectivenessoftheproceduresaresupervisedbytheAgency
forHealthTechnologyAssessmentandTarification35.Therefore,incertainareasof
Polandsuchprogramsmaynotbeavailableoraccesstothemisseriouslylimited.
ItseemsthatthePolishlegislatordoesnottreatthisissueasapriority,leavingiton
theself-governments’shoulders36.Itisnoticedthatmedicallyassistedreproduction
andhumanembryoresearchtestthesocietyinvariouswaysmostlyduetothefact
thatthesocietyisinvolvedatallitslevels-fromcultural,throughreligious,social,
medicaltolegislativewithdifferentpositionsandpointsofviewandrequirespecial
supportandcontributionoftheentiresociety,includinglegislators,physicians,as
wellashumanrightsorganizationsandwomen’srepresentatives37.Unfortunately,
thePolishlegislator,consequentlyavoidsdifficulttopicsandremainssilentleaving
women(families)withinsufficientsupport.
