ablefortheinterpretationofthePolishprovisionsconcerningtheclaim
forinformationbasedonagriculturalexemption,includedinu.o.p.o.r.

U.O.P.O.R.INPOLISHCASELAW
Thequestionwhether,accordingtoArt.23au.o.p.o.r.,thepremiseof
someindicationisnecessaryforsubmissionoftheclaimforinformationhas
alreadycomeupinthePolishcaselawandgenerateddivergentrulings.
AccordingtothecaselawestablishedbytheCourtofAppealinSzczecin11,
theanswerisaffirmative,whereas,accordingtothecaselawoftheCourt
ofAppealinWrocław,12Gdańsk,13Białystok14andŁódź,15theansweris
negative.Significantly,thisquestionhasbeenraisedrecentlybythePol-
ishSupremeCourt,intheprecedentrulingthatreads:fltheclaimbased
onArticle23aofthelawonplantvarietyprotectionsubmittedbythe
breeder(orthebreeders’association)againstthefarmer,withthepur-
poseofobtainingtheinformationabouttheuseoftheharvestedmaterial
protectedbytheplantbreederrightasapropagationmaterial,whichis
