beenlodgedforconsiderationbytheCommissionoftheEuropeanCouncil,con-
cludedthatthediferencesbetweennationalrulesofprivateinternationallaw,in-
cludingthosewhicharepassedtosolvenationalconflictssubstantivelabourlaw,
shouldbeseizedinordertopreventasituationinwhichthesocialsituationof
employees(whomakeuseoftheassuredfreedomofmovementwithintheCom-
munity)willbelessfavourable.Itisnotevidentinanyofthepassagesofthedraft
submittedin1976bytheEuropeanCommissionexplainingwhatentailsless
favourableregulationsofworkers’rightsbenefitingfromthefreedomtomigrate
inordertoworkinanotherMemberState.Comparingthelabourlawsinforce
intheMemberStatesonecancometotheconclusionthatattimeslabourlawin
hostcountries,whichwelcomeworkers,arelessandsometimesmorefavourable
tolabourlawsthatareinforceinthehomeMemberStatesoftheworkers.No
comparativestudieshavebeenconductedonthediferencesintheimplementa-
tionofprotectionandcarefunctionsoflabourlawintheMemberStatesofthe
EuropeanUniontoday.Fromfurtherpassagesofthedraftregulation,whichwas
presentedbytheCommissionoftheEuropeanCouncil,onecancometoone
logicalconclusion.Diferentiationofnationalrulesofprivateinternationallaw
applicableinMemberStatesappliedinordertodealwithnationalstandards
ofsubstantiveconflictinlabourrelationscontainingaforeignelement,isunfa-
vourablebecauseitleadstouniformregulationoflabourrelationsofemployees
employedinthesameperiodinoneMemberState.Tus,astatementaboutthe
negativeefectsofdiferentiationofworkers,inparticular,theirsocialsituation,
shouldbeunderstoodasanexpressionoftheEuropeanCommission’sattention
toallworkers,notjustthosewhodecidedtomakeuseoflawasenshrinedin
primaryandsecondarystandardsofEuropeanlawonfreedomofmovementof
labour.
Variousnationalrulesofprivateinternationallaw,includingnormsindicating
theappropriatedeterminantsthatdeterminethechoiceofthesubstantivelaw
ofthenationalsystemoflabourhadbeenclassifiedbytheEuropeanCommis-
siontooneofthetwoconflictingwitheachmodellaw.Accordingtothefirst,
substantivelabourlawstandardsareinthemajorityofthemandatorynatureof
therules,andforthisreasonareclassifiedasloidepoliceetdesûreté,andthiscon-
sequentlymakestheemploymentrelationshipissubjecttotheprovisionsofthe
MemberStatewheretheworkisbeingconducted.Fromaproceduralpointof
view,disputesaboutclaimsofworkerswithemploymentrelationshipsinvolving
aforeignelementshallbesettledbythecompetentcourtsfortheplaceofwork
(lexlocilaboris),inthejurisdictionwheretheclaimswereled(lexfori).Accord-
ingtoadiferingview,whichliesattheheartofthebeliefintheabsolutenature
oflabourlaw,thoselabourrelations,involvinganinternationalelementshould
beregulatedbylabourlawsoftheMemberStateofthenationalityoftheparties
whichhaveestablishedtheselegalrelationships.Intheabsenceofacommon
