Tereisnodoubtthatcopyrightprotectionhasgonetoofar.Inthisregard,
EuropeanCourtofJustice(“ECJ”)jurisprudenceisambiguous.Ontheonehand,
theCourthasrepeatedlysignalleditsbroadunderstandingoftheconceptofawork1.
Ontheotherhand,claimingthattheCourtisseekingtorestrictthescopeofprotec-
tionbyafunctionalinterpretationofcopyrightappearstobejustified.ECJrulings
regularlyusephraseologywhichinmyopinioncannotbeaccidentalbutsupportsthis
conclusion.Ifthisisthecase,thisstanceistobewelcomed,becausethemajorconse-
quencewillbetolimitsuchcopyrightprotectionwhichnowadayscannotberationally
justified.Tisshouldbetreatedasanadjustmenttopresentdayreality,inwhichweare
prosumers,simultaneouslyproducingandconsumingculturalgoodswhicharerapidly
growinginnumberduetotheavailabilityofcreationtools,amongotherreasons.Tese
factors,ifonlybywayofexample,shoulddefinitelyinfluencetheshapeofcopyright
legislation,especiallyrelatedtoanauthor’sexclusivemonopoly.
1.INTRODUCTION
SincecopyrightwasharmonizedatEuropeanlevel(atleastinrelationtocopyright
exploitationrights,referredtoinDirective2001/292),theECJhashadtheopportu-
nitytoruleonmatterswhichmaybehelpfulindetermininghowfartheprotectionof
authors’interestsshouldbeextended.Ontheonehand,thebasicassumptionisthat
copyrightshouldbeinterpretedbroadly3,asitshouldprovideauthorswitha“high
levelofprotection”4.Ontheotherhand,thescopeoftheserightscannotbeextended5.
