thebill;andinthecaseofurgentbillsorthoseimplementingtheEuropeanUnion
law,withinthedeadlinespecifiedbytheMarshaloftheSenate.Adebateandvoting
takeplaceataSenatesessionandtheSenateadoptsaresolution.Theresolutionmay
includeamotiontoacceptthebillwithoutamendmentsoramotiontorejectthebill
initsentiretyortointroduceamendmentstoitstext(inthiscase,thebillisreferred
backtotheSejm).IftheSenatefailstosubmitamendmentsortorejectthebillwithin
theprescribedperiodof30days(withsomeexceptions),thebillisconsideredpassed
inthewordingadoptedbytheSejm.
TheSejmmayrejecttheSenate)samendments,aswellasthemotiontorejectthebill
byabsolutemajorityofvotes(thenumberofaffirmativevotesexceedsthenumberof
negativevotesandabstentions)inthepresenceofatleasthalfofthestatutorynumber
ofdeputies.Ifthereisnoabsolutemajority,thefinaltextofthebillwillincludethe
Senate)samendments.
WhenthepositionoftheSenateisconsidered,theMarshaloftheSejmrefersthebill
tothePresidentoftheRepublicforsignature.ThePresidentoftheRepublicofPoland
signsthebillwithin21daysfollowingitssubmission(7daysinthecaseofurgent
billsanddraftbudgets)andordersitspromulgationintheJournalofLaws(Dziennik
Ustaw).Thepromulgationisnecessaryforthebilltobecomeabindinglaw.
ThePresidenthasarighttorefusetosignthebillandcanreferitback,withreasons
given,totheSejmforitsreconsideration(so-calledsuspendingveto).IftheSejmover-
ridesaPresident)svetobyamajorityofthree-fifthsofvotesinthepresenceofatleast
halfofthestatutorynumberofdeputies,thePresidenthasnootherchoicethanto
signthebillandorderitspromulgation.Inthecasewhenthereisnosuchmajority,
thelegislativeprocessisfinishedandthebillwillnotcomeintoforce.
ThePresident,inthecaseofanylegaldoubtsconcerningthebillpassedbytheParlia-
ment,maymakeanapplicationtotheConstitutionalTribunalconcerningthecon-
formityofthebillwiththeConstitution.Nevertheless,ifthePresidentexercisesthis
right,hecannotusethesuspendingveto.Havingconsideredthematter,theTribunal
decideswhetherthebillisconstitutional.IftheTribunalstatesthatthebillisconsist-
entwiththeConstitution,thePresidentisobligedtosignit.IftheTribunalfindsthe
entirebillinconsistentwiththeConstitution,thePresidenthastorefusetosignit.
