288§1oftheCriminalCodeof1997,intentionaldamagetopropertyis
aprohibitedact.Iftheperpetratoractsunintentionally,heorshedoesnot
committhisprohibitedact,althoughheorshedoescommitanactwithin
themeaningofthecriminallaw,sincesuchbehaviourafectslegalgoods
incirculation.However,criminallawdoesnotprovideforapenaltyfor
suchanact.
§2Criminalconductanditsunlawfulness
PursuanttotheprovisionofArticle115§1oftheCriminalCodeof1997,
aprohibitedactishumanconductwiththecharacteristicssetoutinthe
criminalstatutelaw.Tus,itisthelawthatdetermineswhoisthesubject
ofsuchanact(theperpetrator),whattheprohibitedconductconsistsof
andwhetheritshouldbeintentionalorunintentional.
Iftheperpetrator,bytheirconduct,fulfilstheelementsofaprohibited
actasdescribedbythelaw,theirconductis,inprinciple,unlawful.Tus,
thereisapresumptionofunlawfulnessassociatedwiththecommission
ofacriminalact.
§3Guilt
Guiltisoneoftheelementsofacrime.Tereisnocrimewithoutguilt
(Article1§3oftheCriminalCodeof1997).Teprerequisitesfortheattri-
butionofguiltareexaminedatthemomentthecriminalactiscommitted.
Teseincludetheageoftheperpetrator(i.e.asarule,17yearsofageor
older),theperpetrator)ssanity,theabilitytorecognisetheunlawfulnessof
theactandthenormalmotivationalsituation(commissionoftheforbid-
denactunderordinarycircumstancesinwhichnofactorscompelledthe
perpetratortosuchbehaviour).
