§4Socialharmfulnessoftheact
Whenanofenceiscommittedbytheperpetrator,thecriminalisationof
theofencedependsontheassessmentofthedegreeofsocialharmfulness
oftheact.Ifitisnegligible,thenthereisnoofence(Article1§2ofthe
CriminalCodeof1997).Ifitishigherthannegligible,anofencemaybe
attributedtotheperpetrator.Telegislatordefinesthecriteriaforassessing
thedegreeofsocialharmfulnessofanactinArticle115§2oftheCriminal
Codeof1997.Teseincludethetypeandnatureoftheinfringedgood,
extentoftheharmcausedorthreatened,mannerandcircumstancesin
whichtheactwascommitted,gravityoftheobligationsviolatedbythe
perpetrator,formofintent,motivationoftheperpetrator,typeofviolated
precautionaryrulesanddegreeoftheirviolation.
