ANDCARRYINGONECONOMICACTIVITY
1.Freedomofeconomicactivity
Freedomofeconomicactivityistheprincipalruleofeconomic
activityinPoland.Itgivespersonsorlegalentitiesfreedomtounder-
take,conductandterminateeconomicactivity(Art.6FEA).Accord-
ingtotheActeveryoneisfreetoundertake,conduct,andterminate
economicactivities,inaccordancewithequalrightsandpursuant
tothetermsandconditionssetforthbythelaw.
Owingtotheimportantpublicinterestinvolved,restrictions
onthefreedomofeconomicactivitymustbeintroducedandset
forthinActsofLaw(Art.6PolishConstitution).
2.Equalityofentrepreneurs
Thelawprovidestherulethatpersonshavingsimilarlegalsit-
uationshaveequalrights,includingstate-ownedentities.Ofcourse
therulecannoteliminatenaturalmarketinequalitiesamongentre-
preneurs.
3.SupportofentrepreneursbytheState
TheStateshallprovideentrepreneurswithpublicaid
onthetermsandintheformsprovidedforinseparateprovisions,
withduerespectfortheprinciplesofequalityandfaircompetition
(Art7FEA).Publicadministrationauthoritiesshallsupportthede-
velopmentofentrepreneursbycreatingfavourableconditions
forentrepreneurstoundertakeandconducteconomicactivities
(Art.8FEA).
4.RespectfortheinterestsofentrepreneursbytheState
Publicadministrationauthoritiesshall,whilecarryingouttheir
tasks,inparticulartasksrelatedtosupervisionandcontrol,act
withduerespectforthelegitimateinterestsofentrepreneurs(Art.
9FEA).
Anentrepreneurmaysubmitanapplicationtoacompetentau-
thoritytoissueawritteninterpretationofthescopeandapplication
oflegalprovisionsunderlyingtheentrepreneurs’obligationtopay
apubliclevy;thisinterpretationmayrefertoindividualcasesonly.
