TheCourt
Article14.1.Casesinrestructuringproceedingsshallbeexamined
byarestructuringcourt.Thedistrictcourt-commercialcourtshallbethere-
structuringcourt.
2.Thecourt,madeupofonejudge,shalladjudicate.Adjudication
ofanappealagainstthedecisionrenderedbyajudge-commissionerand
ontheremunerationofacourtsupervisororanadministratorinthearrange-
mentproceedingsandremedialproceedingsshallbedecidedbyapanel
ofthreeprofessionaljudges.
3.Whentherestructuringproceedingsareopen,thecourtshallnot
becomposedofajudge-commissionerorhisdeputy.
4.inthecaseofrescissionofthedecisionrenderedbythejudge-
commissionerandremand,thejudge-commissionershallbeexcludedfrom
theremand.Thisexclusionshallalsoapplytotherescissionofadecision
issuedasaresultofremand.insuchasituation,thecaseshallbeexamined
bythedeputyjudge-commissioneroradesignatedjudge.
Article15.1.Restructuringcasesshallbeexaminedbyacourtcom-
petentforthecentreofthedebtor’smaininterests.
2.Thecentreofthedebtor’smaininterestsshallbeconstruedasthe
placewherethedebtorregularlyadministershisactivitiesofaneconomic
natureandwhichisrecognisableassuchtothirdparties.
3.inthecaseofacorporateentityandanorganisationalunitwithout
legalpersonalitytowhomanotherlawprovideslegalcapacity,itshallbe
presumedthatthecentreofitsmaininterestsistheplaceofitsregistered
office.
4.inthecaseofanaturalpersonconductingbusinessand/orprofes-
sionalactivity,itshallbepresumedthatthecentreofhismaininterestsisthe
principalplaceofconductingbusinessand/orprofessionalactivity.
5.inthecaseofanaturalpersonwhodoesnotconductbusinessand/or
professionalactivity,itshallbepresumedthatthecentreofhismaininterests
isthehabitualresidenceofthatperson.
