atranssexualpersontogetmarriedwithanindividualofthesamebiologicalsex

thatthepetitionerpossessedbeforethesexchange.Furthermore,fearswerevoiced

thatsuchmarriedcouplescouldalsoadoptchildren.Itisimportanttorealize,

though,thatthelast-mentionedfearsandreservationsareequallyapplicablewith

regardtotheexistingcourtpractice,whichhasprevailedinPolandformorethan

50yearsnow.

ThepresidentialvetowasnotoverturnedbytheParliament(althoughthe

Constitutionallowsforit)sincethelegislativeworksconcerningthevetowerenot

completedbeforetheendofparliamentaryterminNovember2015.Thenewly

electedParliament,inwhichconservativeforcesprevail,hasnottaken,sofar,any

initiativeinthediscussedarea.Itisveryunlikely,too,thatsuchinitiativeswill

comeupintheforeseeablefuture.

9.Gaysandlesbiansmovementsandthesituationoftranssexuals

IthastobenotedthatPolandhaspreservedatraditional(conservative)

modeloffamilylaw.Thecornerstoneofthesystemismonogamous,heterosexual

marriage.Asitwasalreadymentioned,nosame-sexmarriagesareallowed.There

arenoregisteredpartnerships,either,nomatterifhomo-orheterosexual.Repeated

campaignsofgayandlesbianmovements,supportedbyamoreliberalpartofthe

Polishsociety,neverresultedinanychangeoflaw.45

Inefect,thereisaninterestingcontrastbetweenthesituationoftranspersons,

whichformanyyears-duetothejudicialactivism-haveenjoyedthepossibility

ofthesexchange,andthesituationofhomosexualswhoneversucceededin

gettinganylegalconcessions.Inthelightofthelaw,samesexrelationshipsare

treatedasinformal,factualunionsthat-withsomeveryminorexceptions-are

completelyirrelevantfromthelegalpointofview.

Still,afterthefailureofthe2015Act,thegayandlesbianmovements

continuetoacthandinhandwithtranssexuals.Themissionofvariousnon-

governmentalorganizationsactiveinthisarea,suchastheassociation“Kampania

PrzeciwHomofobii”(“CampaignAgainstHomophobia”),oftencombinethe

promotionofinterestsofbothtransgenderandhomosexualpersons.They

concentrateoncombatingdiscriminationandprejudicebasedonsexidentity

andsexorientation.Theyalsokeeponﬁghtingforappropriatelegalregulations

inthisﬁeld.
