andtheoppositesexidentityispermanentandirreversible,itiscommonlyagreed
thattheoriginalentryinthebirthactcanbecorrected.
Asfarasthecaselawisconcerned,theSCallowedthecorrectionofthebirth
actofanintersexualpersonasearlyasin1958.48Theleadingcasewassomewhat
peculiar,though,becauseitwasarguedbeforethecourtthat,atthetimeofbirth,
therewasaclearpreponderanceofbiologicalmalefeaturesofthechild,which
meantthatascribingthechildtothefemalesexwasbutamistake.Suchmistakes
-asitwasalreadyexplainedinsection2supra-arecorrectedinspecialnon-
contentiouscourtproceedings.Thisverytypeofproceedingshasbeenusedin
othercases,too,inwhichtheoriginaldecisionconcerningthebiologicalsex,as
indicatedinthebirthact,waschallengedbyintersexualpersons.Itissubmitted
thattheSCjudgmentsof1989and1992(citedinsection5.2.above),which
stoppedtheuseofcorrectionprocedureswithregardtotranssexuals,didnot
concernintersexpeople.Theavailabilityofcorrectionproceedingsinthistypeof
caseswasendorsedbyoneoftherecentSCrulingsofDecember6,2013.49
Itisnotclear,though,whetherthebirthactcorrectionshouldhaveafully
retroactiveefecthere.ThechangeofentriesintheCivilStatusRegisterusually
takesplacewithregardtogrownupintersexualpersonswhentheiractualsex
identitycanbeconclusivelyascertained.However,theresultingcorrectionandthe
indicationofthe4new’sexinthebirthactopensthequestionconcerningthetime
periodinwhichagivenindividualplayedadiferentsocialrole(omciallybeing
apersonoftheoppositesex).Itseemsthatissueslikethatneedtobeaddressed
bythelegislator.
12.Conclusions
Asitwasdemonstratedinthispaper,thesituationoftranssexualand
transgenderpersonsinPolandisrathercomplexandfarfromclear.Ontheone
hand,formorethan50yearsthejudiciaryhasbeenreadytoassistsuchpersons
-inonewayoranother-intheirattemptstoreconcilethelegalsexwiththeirsex
identity.Ontheotherhand,uptonownowrittenlawhasbeenputinplacesothat
therightsoftheaboveminoritiescouldbeproperlyrespected.Inconsequence,
thepositionoftranspersonsseemsunstableand,atleasttosomeextent,opento
subjectivetreatmentonthepartofjudges.Thissituation-inthehumbleopinion
oftheauthor-hardlyconformstoproperdemocraticstandards.
