ticularconstructionofhighways).Secondly-bypropercombination-elu-

Consideringtherelationshipbetweenroadsafetyandroadaccidentvic-
timprotection,itshouldbeassumedthattherighttoprotectionisguaran-
teedtoeveryvictimofroadaccidentthattookplaceintheEU.Referringto
theresponsibilitytoprotect-aconceptadoptedatagloballevel-itmaybe
statedthattheinternationalcommunityisresponsibleforundertakingactive
actionsincaseofviolationofthisright.Reachingaconsensusandadopting
theresponsibilitytoprotectconcepthasledtoaddingthedutyofensuring
thehumansafetytothestate)ssafety42.
Adoptingthisconcepttopotentialandactualroadaccidentvictims,it
canbestatedthattheMemberStateensuresroadsafety(aspartoftheright
ofprotection)basingonthedeterminantsmentioned.
