Abstract:Thispaperattemptstodescribetheworkingofcapitalpunishmentwithintheframeofthe
Athenianlegalsystem,takingintoaccountthelatter’speculiaritiesandidiosyncracies.Inthefirst
place,itapproachestheproblemoftheso-calledproceduralorientationofAthenianlaw,arguing
thatnodefinitelistofcapitaloffencesinclassicalAthenscanbecompiled.Secondly,itconsidersthe
questionofhowdeathpenaltywasimposedinclassicalAthensandwhatwereitsviablesubstitutes.
Finally,itlooksatthedifferentwaysofitsexecution,withparticularattentiongiventohemlock
poisoningandbloodlesscrucifixion(apotympanismos).

TheAthenianlawappliedthedeathpenaltywithtrulydraconianseverity.It
is,however,remarkablethatnodefinitelistofcapitaloffencescaneverbe
compiled.1ThisisfirstlyduetoourfragmentaryknowledgeoftheAthenianlaw
itself,itsworkingsanditsenforcement.Butwhatwedoknow,insteadofclarifica-
tion,bringsfurtherdisorderintoanalreadyhazyandincompletepicture.
