ecuted.herulingofanintermediatepenaltyservesapositivepurposenotonly

fortheoﬀenderbutalsoforthevictimofthecrimeandthesocietyasawhole.

Asaresultthismethodiseconomicallysuperiortoimprisonment.

heapprovalofthisexpandedsystemofpunishmentsmayproverathercom-

plicatedatthelevelofcourtsentencing.However,theexpectationsconnected

withitareconcernedwithapunishmentcommensuratetothesocialmenace

createdbytheoﬀenderaswellashisorherpersonalcharacteristics.Reasonable

penalrepressionshouldcontributetotheabatementofthenegativephenomenon

ofcommittingthecrimeagainandgreaterﬂexibilitywithregardtocourtrulings.

Intermediatepenaltiesshouldbeintegratedwiththeexistingcomprehensive

systemofpenalmeasures.Penalpolicycanbeexecutedeﬀectivelyonlyifthe

totalofpenaltiesissupplementedwithpenaltiesadjustedtovariedtypesofof-

fencesanddiﬀerentcategoriesofoﬀenders,onconditionthatthesesanctionscan

beeasilyexecuted.

Atpresentboththeoristsandpractitionersintheﬁeldstresstheproblemof

signiﬁcantoverpopulationinprisonsanddetentionhouses,aswellastheinef-

fectivenessoftheconditionalreleasefromservingthefullsentenceandthesus-

pendedsentenceasstandardprobationmeasures.Asaresultweshouldnolonger

givepreferencetoimprisonmentasaprincipalpenalty.Atthesametimethe

decisionsoflenientprobationmeasuresaretakentoofrequently.husweshould

focusonaformofpunishmentcombiningharshrepressionswithsupervisionat

large;theseconditionsareundoubtedlyfulﬁlledbyintermediatepenalties.

Untilnowtheinstitutionalizationofthesystemofpenaltiessituatedinbe-

tweenimprisonmentandstandardprobationhasnotbeenaccomplished.Im-

prisonment,beingaprincipalpenalty,hasrecentlybeenappliedonlysparingly.

Inaddition,itfailstoprovideasuﬃcientnumberofpossiblesolutions.hese-

lection,plausibleinthefuture,betweenthoserightfullysentencedtoimprison-

mentandthoseforwhomanintermediatepenaltyhasbeenadjudicated,cannot

beentirelybasedonthegravityofthecommittedcrimeorthefrequencyof

theoccurrenceofthespeciﬁccriminalactinaparticulararea.Similarcriteria

shouldalsonotbetakenintoaccountwithregardtothechoicebetweenproba-

tionmeasuresandintermediatepenalties.
